Welcome to ViamPeak. These Terms of Service ("Terms") govern your access to and use of the ViamPeak website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of our Services immediately.

1. User Agreement

By using the ViamPeak online store, you confirm that you are at least 18 years of age or are accessing the Services under the supervision of a parent or legal guardian. You agree to use the Services solely for lawful purposes and in a manner consistent with these Terms and all applicable local, national, and international laws and regulations.

You are responsible for ensuring that any information you provide to ViamPeak (including shipping details and payment information) is accurate, current, and complete. You agree not to use the Services for any unauthorized or fraudulent purpose, including but not limited to reselling our products without prior written consent.

ViamPeak reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including if we believe that a customer has violated these Terms or engaged in prohibited conduct.

2. Product Information & Usage

ViamPeak offers a curated selection of hair care tools, including blow dryers, cleansing brushes, and curling irons. We strive to display accurate product descriptions, specifications, and images. However, we do not warrant that product descriptions, colors, or other content are completely error-free, accurate, or reliable. In the event of a discrepancy, the information on the product packaging shall prevail.

All products are intended for personal, household use only, unless otherwise explicitly stated. You agree to follow all safety instructions and guidelines provided with each product. ViamPeak shall not be liable for any damage or injury resulting from misuse, improper handling, or failure to follow the manufacturer's instructions.

3. Intellectual Property

All content included on the ViamPeak website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of ViamPeak or its content suppliers and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without the prior written consent of ViamPeak. You may not use any meta tags or any other "hidden text" utilizing the ViamPeak name or trademarks without our express written permission.

The ViamPeak name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ViamPeak or its affiliates. You must not use such marks without the prior written permission of ViamPeak. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.

4. Limitation of Liability

To the fullest extent permitted by applicable law, ViamPeak, its officers, directors, employees, agents, licensors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Services, or any products purchased through the Services.

In no event shall ViamPeak's total aggregate liability to you for all claims arising from or relating to these Terms or your use of the Services exceed the amount actually paid by you to ViamPeak for the specific product or service giving rise to the claim, or one hundred US dollars ($100), whichever is greater.

Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such jurisdictions, ViamPeak's liability shall be limited to the maximum extent permitted by law.

5. Refund Policy

ViamPeak is committed to your satisfaction. If you are not entirely satisfied with your purchase, you may be eligible for a refund in accordance with the terms set forth below.

Eligibility: To qualify for a refund, products must be returned within 30 days of the original purchase date. Items must be unused, in their original packaging, and in the same condition in which they were received. Proof of purchase (order number or receipt) is required for all returns.

Non-returnable items: For hygiene reasons, cleansing brushes and other personal care items that have been opened or used cannot be returned unless the product is defective or damaged upon arrival. Blow dryers and curling irons must be returned with all accessories and manuals included.

Defective or damaged products: If you receive a defective, damaged, or incorrect product, please contact us at [email protected] within 14 days of delivery. Include your order number, a description of the issue, and clear photographs of the product and packaging. We will assess the issue and, upon approval, issue a full refund or replacement at no additional cost to you.

Refund process: Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed within 5–10 business days to your original method of payment. Shipping and handling charges are non-refundable unless the return is due to our error or a defective product.

Return shipping: You are responsible for the cost of return shipping unless the return is a result of our error or a defective product. We recommend using a trackable shipping method, as ViamPeak is not responsible for items lost or damaged during return transit.

6. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.
